  • Sweepstakes management: Design, execution, and management of promotional sweepstakes for clients
  • Event marketing and activations: Planning and execution of marketing events
  • User-generated content campaigns: UGC strategy and campaign management
  • Marketing consultation and strategy: Expert guidance for promotional campaigns
  • Free resources and tools: Prize Strategy Optimizer, Campaign Idea Generator, and other marketing tools for professionals

Note: We specialize in sweepstakes, not skill-based contests. Sweepstakes-specific terms and conditions are outlined in individual campaign official rules.

3. User Accounts and Registration

When you create an account or provide your email address to access our resources, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your account information secure
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Transmit spam, unsolicited communications, or malicious content

Professional services are provided based on agreed-upon statements of work. We strive to deliver high-quality services but cannot guarantee specific business outcomes or results.

Client Responsibilities

Clients are responsible for:

  • Providing accurate information and requirements
  • Ensuring compliance with applicable laws and regulations
  • Obtaining necessary approvals and permissions
  • Timely payment of agreed-upon fees

7. Privacy and Data Protection

Website and Tool Data

When you use our website or free tools, we collect data as described in our Privacy Policy, including:

  • Email addresses (with consent for marketing communications)
  • Tool inputs and preferences

Sweepstakes Participant Data

If you enter a sweepstakes we manage for a client:

  • Entrant data is collected and managed by third-party platforms (Gleam.io or Sweeperoo.com). We do not retain this data.
  • Winner data is collected directly from winners and stored securely in Canada using encrypted local storage (not cloud services).
  • Winner data is retained for a maximum of 3 years from prize delivery, then permanently deleted.

8. Disclaimers

The Service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

9. Limitation of Liability

To the fullest extent permitted by law, Skillful Squirrel Creative Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Skillful Squirrel Creative Inc. from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately.

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Ontario, Canada.

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
